End User License Agreement

Effective Date: April 8, 2026

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Wartraf sp. z o.o. ("we," "us," or "our") for the use of the Smart Calorie AI mobile application (the "App"). By downloading, installing, or using the App, you agree to the terms of this EULA.

1. Grant of License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, in accordance with the Apple App Store Terms of Service.

2. Restrictions

You agree not to:

• Copy, modify, or create derivative works based on the App.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Rent, lease, lend, sell, redistribute, or sublicense the App.
• Remove or alter any proprietary notices or labels on the App.

3. Ownership

The App and all intellectual property rights therein are and shall remain the exclusive property of Wartraf sp. z o.o. and its licensors. This EULA does not transfer any ownership rights to you.

4. In-App Purchases and Subscriptions

The App may offer in-app purchases or auto-renewable subscriptions. All payments are processed through the Apple App Store and governed by Apple's terms. You can manage subscriptions through your Apple ID account settings.

5. Updates

We may, from time to time, provide updates, patches, or new versions of the App. These updates may be required to continue using certain features and are governed by this EULA unless accompanied by a separate license.

6. Health & Nutrition Disclaimer

Smart Calorie AI is intended as an informational tool only. It does not provide medical advice and should not replace consultation with a qualified healthcare professional. Nutritional values shown in the App are estimates generated by AI and may not always be accurate.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Wartraf sp. z o.o. be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the App.

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete it from your devices.

10. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

11. Governing Law

This EULA shall be governed by the laws of Poland, without regard to its conflict of law provisions.
