Welcome to Smart Calorie AI. These Terms of Use ("Terms") govern your access to and use of the Smart Calorie AI mobile application (the "App") provided by Wartraf sp. z o.o. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the App. By using Smart Calorie AI, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful or harmful purpose.
• Reverse engineer, decompile, or disassemble any part of the App.
• Attempt to gain unauthorized access to our systems or other users' data.
• Use the App in a way that could damage, disable, or overburden our services.

4. Health Disclaimer

Smart Calorie AI provides nutritional estimates for informational purposes only. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your diet, especially if you have a medical condition. Calorie and macro values are estimates and may not be accurate for every meal.

5. Subscriptions and Payments

Some features of the App may require a paid subscription. Subscriptions are billed through your Apple ID account and renew automatically unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID settings.

6. Intellectual Property

All content, trademarks, logos, and software within the App are owned by Wartraf sp. z o.o. or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. User Content

You retain ownership of the photos and data you submit through the App. By using the App, you grant us a non-exclusive, royalty-free license to process this content solely to provide and improve the App's features.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in conduct that we deem harmful to the App or other users.

9. Limitation of Liability

To the maximum extent permitted by law, Wartraf sp. z o.o. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App. The App is provided on an "as is" and "as available" basis without warranties of any kind.

10. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Effective Date." Continued use of the App after such changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.
